Negotiated settlement should be the first strategy when resolving a dispute or claim. Alternative Dispute Resolution pathways, such as arbitration and litigation, should be a last resort.

Settlement through negotiation is often quicker and can eliminate delay and cost. This is often true even when the likelihood of a contested win is high.

This route starts with presenting the counterpart a well drafted ‘statement of case’ prior to contact via legal channels. This often prevents the situation from escalating and sometimes brings the parties to the table to resolve matters through negotiation.
